FLAMINGO FOCUS最终用户许可协议 (EULA)
重要提示：请在下载、安装或使用 FLAMINGO FOCUS（以下简称“应用”）之前仔细阅读本最终用户许可协议（以下简称“本协议”）。

4. 知识产权

5. 免责声明

End User License Agreement (EULA)

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING FLAMINGO FOCUS ("APPLICATION").

This Agreement is a legal agreement between you ("User" or "you") and [Please insert your company name or personal name] ("we," "us," or "Licensor") regarding your use of this Application. By downloading, installing, or using this Application, you agree to be bound by the terms of this Agreement. If you do not agree to all the terms of this Agreement, do not download, install, or use this Application.

1. License Grant

Subject to your compliance with the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and use this Application on a compatible Apple device that you own or control, solely for your personal, non-commercial purposes.

2. Restrictions on Use

You shall not, and shall not permit any third party to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of this Application, except as expressly permitted by applicable law.

  • Modify, adapt, translate, or create derivative works based on this Application.

  • Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer this Application or any rights granted under this Agreement.

  • Remove, obscure, or alter any copyright notices, trademarks, or other proprietary rights notices contained in this Application.

  • Use this Application in any manner that violates applicable laws or regulations.

3. Subscription Services

Flamingo Focus offers auto-renewing subscription services that provide access to premium features and content.

  • Subscription Options:

    • Weekly Access weekly): The subscription period is 1 week, and the price is $2.99 USD (or equivalent local currency).

    • Yearly Access (yearly): The subscription period is 1 year, and the price is $9.99 USD (or equivalent local currency).

  • Payment: Payment will be charged to your Apple ID account at confirmation of purchase.

  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription price mentioned above.

  • Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your App Store Account Settings after purchase.

4. Intellectual Property

This Application and all its content (including but not limited to text, graphics, images, audio, video, software, and trademarks) are protected by copyright laws, trademark laws, and other intellectual property laws. All rights, title, and interest in and to this Application remain with us or our licensors. Any rights not expressly granted to you under this Agreement are reserved by us.

5. Disclaimer of Warranties

THIS APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THIS APPLICATION WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THIS APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THIS APPLICATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE APPLICATION DURING THE PAST 12 MONTHS (IF ANY).

7. Termination

We may terminate this Agreement immediately without notice if you breach any term of this Agreement. Upon termination of this Agreement, you must cease all use of this Application and delete all copies of this Application from your device.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of [Please insert your country/region], without regard to its conflict of law principles. 9. Miscellaneous

Your use of the Application must also comply with Apple's App Store Terms of Service.
